O presente estudo versa acerca da influência dos valores patriarcais na atuação do Poder Judiciário brasileiro no tocante ao crime de violência sexual contra a mulher. Realizada mediante a adoção do método dedutivo, com abordagem qualitativa documental, a pesquisa se propôs a responder à complexa questão: os operadores do direito perpetuam e legitimam comportamentos que relativizam o crime de estupro praticado contra a mulher? Após a análise das características do patriarcado ao longo da história civilizatória, dos aspectos sociais e jurídicos sobre o crime de estupro contra a mulher no cenário nacional e da atuação dos juristas durante o caso Mariana Ferrer, o estudo concluiu que os valores de dominação e subjugação do sexo feminino demonstram-se presentes ao longo do processo penal, ainda no contexto social do século 21. Desta forma, a pesquisa evidencia a revitimização da mulher violentada e a utilização do comportamento social e sexual da vítima como argumento de relativização do delito, bem como de culpabilização da vítima.
The present study deals with the influence of patriarchal values in the performance of the Brazilian Judiciary in relation to the crime of sexual violence against women. It is performed through the adoption of the deductive method, with a qualitative documental approach, the research proposed to answer the complex question: do law operators perpetuate and legitimize behaviors that relativize the crime of rape committed against women? After analyzing the characteristics of patriarchy throughout civilizing history, the social and legal aspects of the crime of rape against women on the national scene and the work of jurists during the Mariana Ferrer case, the study concluded that the values of domination and subjugation of the female gender are present throughout the criminal process, even in the social context of the 21st century. Thus, the research highlights the revictimization of the abused woman and the use of the victim's social and sexual behavior as an argument for relativizing the crime, as well as as victim blaming.
