O princípio da cooperação, expressamente previsto no CPC/15, aduz que as partes devem agir conjunta e colaborativamente de forma a atingir o objeto comum: a solução justa através de um processo mais eficiente. Nesse sentido, referido Código trouxe consigo uma cláusula geral negocial (art. 190), positivando os negócios jurídicos processuais (meio pelo qual as partes podem estipular mudanças no procedimento de acordo com sua conveniência e interesses). Apesar disso, fato é que existem algumas limitações a estes negócios, como por exemplo as situações de manifesta vulnerabilidade, nas quais o juiz pode recusar a aplicação dos negócios. A complexidade do tema, por conseguinte, deriva da compatibilização dos negócios jurídicos processuais em processos que envolvam a figura do consumidor, o qual é presumidamente vulnerável. Assim, nos propomos a fornecer uma alternativa que possibilite a realização dos negócios nestes casos, resguardando-se a análise do caso concreto como fator definitivo a se apurar eventual prejuízo. Portanto, após a introdução do tema e delimitação do objeto de estudo, serão conceituados os negócios jurídicos processuais, seu histórico, sua classificação e seus requisitos de validade (capítulo 1). Após, serão estudados os aspectos relacionados ao direito do consumidor, perpassando por sua conceituação, seus direitos e o que se entende por vulnerabilidade e hipossuficiência (capítulo 2). Em seguida, será analisada efetivamente a possibilidade de realização dos negócios jurídicos processuais em processos envolvendo relações de consumo. Neste tópico, trataremos mais a fundo dos requisitos de validade e do princípio do autorregramento da vontade, bem como sobre a vulnerabilidade jurídica, espécie de vulnerabilidade que poderia obstar a realização dos negócios jurídicos processuais. Ademais, serão delineadas três hipóteses que limitam, sob qualquer ângulo, a formação dos negócios (capítulo 3). Ao final, serão feitas algumas observações acerca da discussão e transmitidas ao leitor as conclusões alcançadas pelo autor.
The principle of cooperation, expressly provided in CPC/15, states that parties must act jointly and collaboratively in order to achieve the common goal: a fair solution through a more efficient proceeding. In this sense, said Code brought with it a general negotiating clause (article 190), consolidating the procedural agreements (means by which the parties can stipulate changes in the proceeding according to their convenience and interests). Nevertheless, the fact is that there are some restrictions to these agreements, as for example, the situation of manifest vulnerability, in which the judge may control de validity of the agreement. The complexity of the subject, therefore, derives from the compatibility of procedural agreements in cases involving the consumer, which is presumably vulnerable. Thus, we propose an alternative that enables the conclusion of procedural agreements in these cases, preserving the analysis of the concrete case as a definitive factor to ascertain any loss to any party. Therefore, after introducing the topic and delimiting the object of study, it will be provided a definition about the procedural agreements as well as about their history, classification and validity requirements (chapter 1). Next, the aspects related to consumer law will be studied, going through their conceptualization, their rights and what is meant by vulnerability and hyposufficiency (chapter 2). Then, the possibility of carrying out procedural agreements in lawsuits involving consumer relations will be effectively analyzed. In this topic, we will deal with the validity requirements and the self-will principle, as well as legal vulnerability, kind of vulnerability that could interfere in the procedural agreements. In addition, three hypotheses of restrictions will be delineated that shall limit, from any angle, the formation of the procedural agreements. (chapter 3). In the end, some comments will be made about the discussion and the conclusions reached by the author will be transmitted to the reader.
