Abstract
O presente artigo pretende analisar a aplicação da cláusula de retomada, através do seguro-garantia, sob a égide da Nova Lei de Licitações e Contratos, com a finalidade de entender (i) do que se trata essa cláusula; (ii) seus principais pontos positivos; (iii) se a cláusula vem sendo utilizada nas contratações públicas e (iv) se a cláusula não estiver sendo utilizada, por quais motivos. Dentre os resultados obtidos, verificou-se que a cláusula de retomada através do seguro-garantia figura como uma alternativa para garantir a execução dos contratos públicos de obras e serviços de engenharia de grande vulto. Apesar de ser uma alternativa valiosa, essa modalidade de garantia, e a própria Lei 14.133/2021, não estão sendo aplicadas. Dentre os fatores geradores da perspectiva negativa da aplicação da cláusula de retomada através do seguro-garantia destacam-se: a alta burocratização advinda das disposições da Nova Lei de Licitações e Contratos; o aumento dos custos para as seguradoras e os fatores externos, como a crise econômica do coronavírus. O presente artigo se valerá do estudo do antigo e do novo regime de contratações públicas, da análise de bibliografia acerca do tema e de uma pesquisa empírica através da Lei de Acesso à informação.
This article intends to analyze the application of the resumption clause, through surety bond, under the aegis of the New Bidding and Contracts Law, in order to understand (i) what this clause is about; (ii) its main strengths; (iii) if the clause has been used in public contracts and (iv) if the clause is not being used, for what reasons. Among the results obtained, it was found that the resumption clause through surety insurance figures as an alternative to guarantee the execution of public contracts for large-scale engineering works and services. Despite being a valuable alternative, this type of guarantee and Law 14,133/2021 are not being applied in practice. Among the factors that generated the negative perspective of the application of the resumption clause through surety bond, the following stand out: the high level of bureaucracy arising from the provisions of the New Law on Tenders and Contracts; rising costs for insurers and external factors such as the coronavirus economic downturn. This article will make use of the study of the old and the new regime of public contracts and the analysis of the bibliography on the subject and an empirical research through the Law of Access to Information.
