| dc.description.abstract | O presente trabalho tem por objetivo compreender a extensão do fenômeno governabilidade no contexto atual, bem como definir o impacto das escolhas constituintes na atividade política, avaliando o comportamento do Supremo Tribunal Federal na mediação da relação institucional entre Executivo e Legislativo. Para isso, a pesquisa traça as definições e o ambiente da governabilidade, como também apresenta modelos e arranjos institucionais distintos de governo, com a finalidade de identificar alguma métrica para mensurar a acomodação dos poderes republicanos nos cenários adversos de crise de governabilidade. Com isso, são também apresentadas as vicissitudes e patologias atreladas ao exercício do poder. Dada a hipótese traçada, no sentido de que o Poder Judiciário teria garantido a plena governabilidade em âmbito nacional, são apresentadas noções de ativismo judicial, seus debates históricos e a recepção desse fenômeno no Brasil, mas também compreendidas as razões que ensejam o constante – mas não tão saudável – diálogo entre Poder Executivo e Legislativo, até para se assimilar o modo de interveniência do Judiciário nessa relação. Com efeito, são então esmiuçados os recentes precedentes judiciais que, de modo direto, teriam impactado o ambiente político, com reverberação na atividade dos demais poderes, a fim de se aferir se o Supremo Tribunal Federal tem, de fato, exasperado sua estrita avaliação técnica, passando a figurar como verdadeiro player na atividade de arbitrar e mediar conflitos entre poderes. Finalmente, o trabalho conclui que, de maneira parcial, a hipótese se confirma, na medida em que o Supremo Tribunal Federal realiza testes sutis de seus limites junto aos demais poderes, tem em sua escolha de pauta uma poderosa arma política capaz de alterar completamente os rumos da governabilidade e, entre outros, tem estado confortável na circunstância de figurar como verdadeiro árbitro da relação interinstitucional havida entre Legislativo e Executivo. | |

| local.description.abstracten | This research aims at understanding the extent of the governability phenomenon in the present context, as well as to define the impact of constitution-making power choices on political activity analyzing the behavior of the Federal Supreme Court in the mediation of the institutional relationship between Executive and Legislative. For this reason, the research draws the definitions and the environment of governability, as well as presents different institutional models and arrangements of government, directed towards identifying metrics able to fully measure the accommodation of republican powers in adverse scenarios of governability crisis. With this, the vicissitudes and pathologies associated to the exercise of power are also presented. Given the outlined hypothesis, in the sense that the judiciary power would guarantee the absolute governability at the national level, the study then presents notions of judicial activism, their historical debates, and the reception of this phenomenon in Brazil. Nonetheless, it also comprehends the reasons for the constant - but not so healthy - dialogue between the Executive and Legislative powers, in order to assimilate the manner of intervention taken by the Judiciary in this relationship. Thus, recent judicial precedents that would have directly impacted the political environment are then scrutinized, with reverberation in the activity of other powers, in order to assess whether the Federal Supreme Court has, in fact, exasperated its strict technical evaluation, becoming a true player in the activity of arbitrating and mediating conflicts between powers. Finally, the work concludes that, in a certain way, the hypothesis is confirmed, to the extent that the Supreme Court performs subtle tests of its limits with other powers, it has in its choice of agenda a powerful political weapon capable of altering completely the course of governability and, among others, has been comfortable in the circumstance of appearing as a true player of the interinstitutional relationship between the Legislative and the Executive. | |
