Resumo
O presente artigo trata do período atípico vivenciado mundialmente pela pandemia de COVID-19, onde o sistema de quarentena se tornou a única saída para que proliferação deste vírus fosse menos recorrente. Com foco no grupo de mulheres presas gestantes e lactantes, questiona-se quais medidas estão sendo tomadas pelo Estado para que a proliferação do vírus da COVID-19 seja menor, bem como, se o interesse e direitos destas mulheres têm sido segurados, considerando pesquisas jurisprudências, aplicabilidade da lei penal e recomendações do CNJ para este período. O artigo conta ainda, com uma análise histórica e uma análise do cotidiano de mulheres presas para um enriquecimento ainda maior para a exposição dos fatos da pesquisa.
Abstract: The present article deals with the atypical period experienced worldwide by the pandemic of COVID-19, where the quarantine system became the only way out for the proliferation of this virus to be less recurrent. Focusing on the group of pregnant and lactating women prisoners, it is questioned what measures are being taken by the State so that the proliferation of the COVID-19 virus is reduced, as well as if the interest and rights of these women have been insured, considering case law research, applicability of criminal law and recommendations of the CNJ for this period. The article also includes a historical analysis and an analysis of the daily lives of imprisoned women to enrich the presentation of the facts.
