O direito à moradia é um direito fundamental e também um direito humano. A sua concretização, todavia, não tem sido realizada de forma satisfatória ao longo da história do país. Na tentativa de contornar esse quadro até então vigente, houve a publicação, em 22 de dezembro de 2016, da MP 759, convertida posteriormente na lei n.º 13.465/2017, a qual, dentre outras medidas, regulamentou a regularização fundiária urbana. Contudo, desde sua promulgação, o citado diploma legal tem sido encarado com inúmeras desconfianças e acirrada crítica pelo mundo jurídico, especialmente em razão do interesse inesperado e repentino do governo em torno do tema regularização fundiária. Nesse cenário, o presente trabalho tem por intuito realizar uma análise crítica do instituto da regularização fundiária urbana, a fim de examinar a aptidão do referido instrumento para a garantia do direito social à moradia. Para que se atinja tal objetivo, inicialmente haverá uma contextualização histórica dos fatores que levaram ao surgimento das ocupações irregulares. Na sequência, abordar-se-á os principais dispositivos constitucionais e infraconstitucionais que tratam do direito à moradia, com uma busca da definição do conteúdo do referido direito. Por fim, analisar-se-á: (i) a regulamentação dada pela Lei n.º 13.465/2017 à Reurb; (ii) a suposta inconstitucionalidade formal da Lei n.º 13.465/2017, bem como a suposta transformação da Reurb em mera forma de titulação massiva das ocupações irregulares; (iii) os principais problemas que podem ser extraídos do citado diploma legal; e, ainda, (iv) os principais desafios práticos — tanto de ordem jurídica quanto extrajurídica — à efetivação da Reurb, bem como eventuais medidas adotadas pela Lei n.º 13.465/2017 para mitigação de tais desafios, visando-se aferir, após a análise desses fatores, a utilidade e efetividade da regularização fundiária urbana para a garantia do direito social à moradia.
The right to housing is a fundamental right and also a human right. Its implementation, however, has not been carried out satisfactorily throughout the country's history. In an attempt to circumvent this situation until then, MP 759 was published on December 22, 2016, later converted into Law no. 13,465/2017, which, among other measures, regulated urban land regularization. However, since its promulgation, the aforementioned legal diploma has been viewed with innumerable suspicions and fierce criticism by the legal world, especially due to the unexpected and sudden interest of the government on the issue of land title regularization. In this scenario, the present work aims to carry out a critical analysis of the institute of urban land regularization, in order to examine the aptitude of the referred institute to guarantee the social right to housing. In order to achieve this objective, initially there will be a historical contextualization of the factors that led to the appearance of irregular occupations. Then, the main constitutional and infraconstitutional provisions dealing with the right to housing will be addressed, with a search to define the content of that right. Finally, it will be analyzed: (i) the regulation given by Law no. 13,465/2017 to Reurb; (ii) the alleged formal unconstitutionality of Law no. 13,465/2017, as well as the alleged transformation of Reurb into a mere form of massive titling of irregular occupations; (iii) the main problems that can be extracted from the mentioned legal diploma; and, still, (iv) the main practical challenges — both legal and extra-legal — for the realization of Reurb, as well as possible measures adopted by Law no. 13,465/2017, to mitigate such challenges, aiming to assess, after the analysis of these factors, the utility and effectiveness of urban land regularization to guarantee the social right to housing.
