A democracia direita como direito fundamental da quarta dimensão e o exercício da cidadania no âmbito dos ciclos de conferências da defensoria pública do estado de São Paulo

O presente trabalho tem o objetivo de apresentar a democracia direta como um direito fundamental da quarta dimensão, cuja prestação e cumprimento, assim como no caso dos demais direitos fundamentais conquistados pelo homem, também é exigível do Estado. No Brasil, o dever de garantia dos direitos fundamentais da população hipossuficiente é de responsabilidade da Defensoria Pública. Assim, considerando as funções da Defensoria e a situação de exclusão social de seus atendidos, foi analisado, sob uma perspectiva teóricolegal, se no caso da Defensoria Pública do Estado São Paulo, o procedimento adotado nos seus Ciclos de Conferências é eficaz para garantir a participação democrática de forma direta, e consequentemente, o exercício de cidadania. Para a confirmação dessa assertiva, se fez necessário entender a evolução histórica da Defensoria Pública e o seu papel dentro do sistema de justiça brasileiro, assim a evolução da teoria dos direitos fundamentais e do Estado de Direito, de modo a conceber a democracia direta como direito da quarta dimensão. Por fim, ficou constatado que, do ponto de vista teórico, a existência de um espaço como o dos Ciclos de Conferências é um meio ideal de concretização da participação democrática direta, que enquanto direito fundamental da quarta dimensão, é indissociável e necessária ao exercício da cidadania. Ademais, viu-se que, no Brasil, a Defensoria Pública serve como expressão do compromisso do Estado Social com a garantia de igualdade material, sendo a participação popular no âmbito institucional a evidência da expansão da cidadania e da governança democrática para além da esfera da vida política.
The following presentation is meant to show direct democracy as a fundamental right of the fourth dimension, whose performance and fulfillment, as well as in the case of other fundamental rights conquered by man, is also required of the State. In Brazil, the Public Defender's Office is in charge of guaranteeing the fundamental rights the people in need. Thus, considering the functions of the Public Defender's Office and the situation of social exclusion of those who seek its services, it was analyzed, from a theoretical-legal perspective, whether in the case of the Public Defender's Office of the State of São Paulo, the procedure adopted in its Conference Cycles is effective to ensure democratic participation in a direct way, and consequently, the exercise of citizenship. In order to confirm this assertion, it was necessary to understand the historical evolution of the Public Defender's Office and its role within the Brazilian justice system, as well as the evolution of the theory of fundamental rights and the rule of law, in order to conceive of direct democracy as right of the fourth dimension. Finally, it was observed that, from a theoretical point of view, the existence of a space such as the Conference Cycles is an ideal means of achieving direct democratic participation, which as a fundamental right of the fourth dimension is inseparable and necessary for the exercise of citizenship. In addition, it has been seen that in Brazil, the Public Defender's Office serves as an expression of the commitment of the Social State with the guarantee of material equality, and the popular participation in the institutional sphere is evidence of the expansion of citizenship and democratic governance beyond the sphere of political life
