| dc.description.abstract | A pesquisa visa trazer uma reflexão sobre a possibilidade de aplicar a modulação temporal dos efeitos da decisão no âmbito penal. Dessa forma, analisa-se a relação dos sistemas civil law e common law a fim de compreender suas características fundamentais e o que pode ser utilizado para eventuais ajustes no direito brasileiro. Ademais, observa se o atual estágio do direito pátrio, em especial o grau que se encontra o poder criativo do magistrado, uma vez que as constituições federais brasileiras e as respectivas legislações permitiram, ao longo do tempo, uma maior intervenção judicial sobre a lei escrita, fato que contribuiu para a insegurança jurídica, e afetou não apenas os contornos clássicos do princípio da legalidade, mas também o da igualdade. Ressalta-se, nessa análise, que a extensão da interpretação do julgador permitiu à jurisprudência ganhar espaço no que tange à fundamentação da decisão, apesar de não ser considerada fonte primária do direito. Nesse cenário, verifica-se que a Suprema Corte, utilizando de forma extensa o poder interpretativo, realiza, com frequência, uma alternância do entendimento jurídico, o que não apenas prejudica a tese adotada pela defesa técnica, mas põe em discussão a possível violação do princípio da legalidade. Assim, ponderar-se-á sobre a aplicação da modulação temporal dos efeitos da decisão no âmbito penal, pois além de já ser aplicada no direito constitucional e, recentemente, o novo Código de Processo Civil trazer essa previsão, é uma alternativa para mitigar a insegurança jurídica vivenciada, garantindo a necessária preservação dos direitos fundamentais no âmbito de uma ação penal. | |

| local.description.abstracten | The research aims to bring a reflection on the possibility of applying the temporal modulation of the effects of the decision in the criminal scope. In this way, the relationship between the civil law and common law systems is analyzed, in order to understand their fundamental characteristics and what can be used for eventual adjustments in Brazilian law. In addition, the current state of national law is observed, in particular the degree to which the magistrate's creative power is found, since the Brazilian federal constitutions and the respective legislation have allowed, over time, greater judicial intervention on the law. writing, a fact that contributed to legal uncertainty, and affected not only the classic contours of the principle of legality, but also that of equality. It should be noted, in this analysis, that the extension of the judge's interpretation allowed jurisprudence to gain ground with regard to the reasoning of the decision, despite not being considered a primary source of law. In this scenario, it appears that the Supreme Court, using its interpretative power extensively, often performs an alternation of legal understanding, which not only undermines the thesis adopted by the technical defense, but also brings into question the possible violation of the principle of legality. Thus, the application of the temporal modulation of the effects of the decision in the criminal scope will be considered, since in addition to already being applied in constitutional law and, recently, the new Code of Civil Procedure brings this prediction, it is an alternative to mitigate the experienced legal insecurity, guaranteeing the necessary preservation of fundamental rights in the context of criminal proceedings. | |
