Embora não haja a pena de morte para crimes considerados “comuns” no ordenamento jurídico brasileiro, ainda há muito que se debater sobre a temática, considerando a análise de seus aspectos históricos, legislações atuais, e possíveis mudanças futuras na norma do nosso país. Sabe-se que a sanção capital até meados do século XIX era uma prática relativamente comum e, de certa forma, até abrangente para diversos tipos penais diferentes. Ao longo do tempo, sobre influência de teóricos, filósofos e pensadores, tais práticas passaram cada vez mais a serem abolidas pelas leis. Conforme os direitos humanos vão ganhando espaço e as sociedades evoluindo humanisticamente falando, a pena de morte, hoje, está quase que erradicada no planeta, restando apenas alguns países no mundo que a mantém tais como China e Estados Unidos, que não apenas a aplicam em situações especiais, como também nos supracitados crimes comuns, como por exemplo, o homicídio. No Brasil, a Constituição de 1988 em seu inciso 47 do art. 5º prevê a sanção apenas em uma situação especial: o chamado “tempo de guerra declarada”, e tais crimes que podem levar a essa punição estão tipificados no nosso Código Penal Militar de 1969.
Although there is no death penalty to crimes declared “common crimes” in Brazil’s legal order, we still have a lot to discuss this topic, considering the analysis of the historical aspects, current laws, and potential future changes in terms of standards in our country. We all know that capital punishment until the 19th century was very rife and, in a certain way, very wide-ranged to some specific penal cases. In the long run, affected by the influence of theorists, philosophers, and great-minded, those practices have been increasingly abolished by law. As human rights have gained ground and societies have evolved humanistically speaking, the death penalty, today, is almost eradicated on the planet, leaving only a few countries in the world that maintain it, such as China and the United States, which not only apply it in special situations, but also in the aforementioned common crimes, such as murder. in Brazil, the Constitution of 1988, in item 47 of art. 5, foresees the sanction only in a special situation: the so-called "time of declared war", and such crimes that can lead to this punishment are typified in our Military Penal Code of 1969.
