O presente trabalho tem por escopo analisar o fenômeno da prisão preventiva a partir da ótica
do Direito Penal do Autor, averiguando se há relação entre o encarceramento provisório
brasileiro e a concepção do acusado como um ser ontologicamente perigoso e, portanto,
necessitado de contenção cautelar. Estabelecida essa premissa, e sendo afirmativa a resposta
para a existência de uma relação prisão preventiva-direito penal do autor, passa-se a avaliar
como se expressa essa concepção no seio do Poder Judiciário, mediante a análise de julgados
correspondentes ao objeto de pesquisa. O resultado do trabalho perpassa por uma análise
histórico-evolutiva do Direito Penal do Autor até os dias atuais, no qual se verifica sua
permanência ainda que diante de um Direito Penal de matriz liberal-garantista, dado à
resistência do Judiciário em se ater a um Direito Penal do Fato e à concepção de que a contenção
daquele tido por “ente danoso” é necessária à defesa da sociedade.
This research has the purpose to analyze the phenomenon of the preventive detention from the perspective of the enemy criminal law, investigating whether there is a relation between the preventive imprisonment and the perception that the accused in a criminal case is a dangerous being and, therefore, in need of a precautionary measure. Having that established, being the answer to the existence of this relationship affirmative, the research evaluates how this conception is expressed within the Courts, throughout the analysis of criminal cases that corresponds to the object of research. The results go through a historical evolution of the enemy criminal law, up to the present day, in which its permanence is verified even though the criminal law has its basis in liberal law and guarantees the rights of the accused of a crime. This permanence is given to the resistance of the Courts to observe the criminal law of the fact analyzed, plus a conception that the preventive detention is needed for those who are considered a dangerous being for the society.
