Este artigo tem por objetivo fazer um comparativo acerca da Avaliação de
Desempenho presente nos contratos públicos regidos tanto pela Lei Federal nº 8.666/93 (Lei de
Licitações) quanto pela Lei Federal nº 11.079/04 (Parcerias Público-Privadas), haja vista a
divergência existente em sua utilização pelo poder público. Para tal análise serão apresentados
conceitos que orbitam os temas pertinentes ao comparativo.
Em um primeiro momento serão apresentados os principais conceitos jurídicos acerca
do processo contratação regido pela Lei 11.079/04, bem como as principais previsões feitas
pelo legislador neste diploma, com objetivo de evidenciar a não existência de quaisquer
dispositivos autorizando a utilização dos indicadores. Depois de analisar tais dispositivos, será
observado o arcabouço jurídico relacionado ao meio de contratação pública previsto na Lei
8.666/93, cujo somente aborda critérios discricionários para a aplicação de indicadores de
desempenho.
Na segunda parte desta produção serão apresentados casos práticos, bem como
jurisprudência de nossos tribunais acerca da utilização dos indicadores de desempenho nos
contratos públicos regidos pela Lei 11.079/04, bem como os desafios para a implementação dos
instrumentos nos contratos regidos pela Lei de Licitações.
Por fim, serão feitos apontamentos e sugestões para como a administração pública
poderá utilizar tal ferramenta com objetivo de fortalecer os contratos públicos regidos pela Lei
8.666/93 e torná-los mais eficientes.
This scientific article has as it goal the exposure of the differences of using evaluation indicators by comparing both types of public bids. The first one is the public bidding under the Federal Law nº 8.666 published on the year of 1993 as well as the second one is the Federal Law nº 11.079 regarding the Public-Private Partnerships which was published in the year of 2004, mainly because there are strong divergencies in its utilization by the Public Authority. To successfully accomplish forging this article it will be manipulated diverse legal concepts linked to the subjects. The first explanation will be around the hot spots surrounding the Public-Private Partnership Federal Law bringing the attention to the fact that there aren’t any potential hurdles in the usage of the evaluation indicators. The next step to manufacture this article will be the discussion of the hot topics circling the environment belonging the Federal Law nº 8.666, as well as clarifying that there aren’t no struggling points to avoid the usage of the evaluation indicators. Right after reviewing as well as discussing the doctrinal and theorical instances it will be presented a research focused on real-life cases and reviewing the positioning of Brazilian courts decisions upon using the Key Process Indicators method within the public bids based in the Law 11.024/04. We will be also addressing the potential challenges and hurdles that the public administration needs to be facing to be implementing on the pubic bids based in the Law 8.666/93. As closing remarks, there will be suggestions and ideas on how the Public Administration can emulate the usage of the indicators in the environment of the Federal Law nº 8.666.
