O debate sobre o aborto legal, especialmente em casos de estupro, é uma questão complexa com implicações éticas, sociais e jurídicas. Esta dissertação busca explorar as interações entre a legislação, dilemas éticos e impactos sociais do "Aborto Legal Proveniente de Estupro e suas Repercussões no Código Penal". A discussão transcende as fronteiras jurídicas, envolvendo direitos reprodutivos, justiça social e proteção da vítima. O Código Penal de 1940, em seu artigo 128, permite o aborto em casos de estupro, mas a complexidade persiste, desafiando compreensões éticas e sociais. O debate contemporâneo é crucial diante das transformações sociais e da busca por equidade de gênero. No cenário brasileiro, recentes eventos, como o caso de uma gestante de 10 anos, evidenciam desafios na aplicação da legislação, ressaltando a necessidade de procedimentos de interrupção da gestação independentemente de autorização judicial. Os dados revelam que, em um país de 212,6 milhões de habitantes, apenas 76 hospitais realizam abortos legalmente, com uma redução para 45% durante a pandemia. O Comitê de Direitos Econômicos, Sociais e Culturais da ONU alerta sobre a negação do aborto como um ato cruel. A mulher tem direito ao aborto em casos de estupro, risco de vida ou anencefalia fetal. Desenvolvimento O objetivo desta dissertação é analisar as repercussões do aborto legal por estupro no Código Penal, compreendendo o amparo legal, as dimensões éticas e os impactos sociais. A metodologia incluiu revisão crítica da literatura, jurisprudências e documentos legais, com análises qualitativas. Buscando oferecer insights para aprimorar políticas públicas e promover discussões construtivas em prol de uma sociedade mais inclusiva. Conclusão A violência sexual e um fenômeno banalizado e alimentado culturalmente durante os anos de patriarcado em que a mulher é culpabilizada. Reconhecido pelo Ministério público como questao de saúde pública. Se caracteriza por qualquer toque sexual não permitido, tentado ou consumado por qualquer pessoa em qualquer ambiente. Inclui o estupro por meio de intimidação, força física ou não, para fins de penetração com o órgão sexual, outra parte corporal ou objeto.Apesar de pautado por lei e definido no artigo 213 do cod penal observa-se que para este só a lei não é o bastante. O assédio sexual envolve um difícil processo cultural de discriminação, desrespeito e difamação, que atinge a vítima e aquelas ao seu redor. Sendo assim a denúncia carrega um peso e dano psicológico além daquele citado por lei. Assim se faz necessário considerar e compreender a dinâmica psíquica que o estupro envolve, assim como suas marcas e consequências psicológicas e patológicas. Nota-se os avanços na legislação brasileira afim de acolher e proteger as vítimas, porém ainda há um caminhar longo quanto à conscientização por meio de órgãos públicos, sociedade e o dos órgãos criminais brasileiros, no que diz respeito aos pensamentos e valores sexista que caminham junto a cultura. O debate precisa ser constante e aberto em sociedade afim de enfraquecer a cultura machista e promover a conscientização e a quebra de tabu em relação a valorização feminina
The debate over legal abortion, especially in cases of rape, is a complex issue with ethical, social and legal implications. This dissertation seeks to explore the interactions between legislation, ethical dilemmas and social impacts of "Legal Abortion resulting from Rape and its Repercussions on the Penal Code". The discussion transcends legal boundaries, involving reproductive rights, social justice and victim protection. The 1940 Penal Code, in its article 128, allows abortion in cases of rape, but the complexity persists, challenging ethical and social understandings. The contemporary debate is crucial in the face of social transformations and the search for gender equity. In the Brazilian scenario, recent events, such as the case of a 10-year-old pregnant woman, highlight challenges in the application of legislation, highlighting the need for pregnancy termination procedures regardless of judicial authorization. The data reveals that, in a country of 212.6 million inhabitants, only 76 hospitals legally perform abortions, with a reduction to 45% during the pandemic. The UN Committee on Economic, Social and Cultural Rights warns against denying abortion as a cruel act. A woman has the right to an abortion in cases of rape, risk to her life or fetal anencephaly. Development The objective of this dissertation is to analyze the repercussions of legal abortion due to rape in the Penal Code, understanding the legal protection, ethical dimensions and social impacts. The methodology included a critical review of literature, case law and legal documents, with qualitative analyses. Seeking to offer insights to improve public policies and promote constructive discussions in favor of a more inclusive society. Conclusion Sexual violence is a phenomenon that was trivialized and culturally fueled during the years of patriarchy in which women are blamed. Recognized by the Public Ministry as a public health issue.It is characterized by any sexual touching that is not permitted, attempted or consummated by any person in any environment. Includes rape through intimidation, physical force or otherwise, for the purpose of penetration with the sexual organ, other body part or object. Despite being guided by law and defined in article 213 of the criminal code, it is observed that for this case, the law alone is not enough. Sexual harassment involves a difficult cultural process of discrimination, disrespect and defamation, which affects the victim and those around her. Therefore, the complaint carries a weight and psychological damage beyond that mentioned by law. Therefore, it is necessary to consider and understand the psychic dynamics that rape involves, as well as its psychological and pathological marks and consequences. Advances in Brazilian legislation are noted in order to welcome and protect victims, but there is still a long way to go in terms of raising awareness through public bodies, society and Brazilian criminal bodies, with regard to sexist thoughts and values that are moving forward. along with culture. The debate needs to be constant and open in society in order to weaken the sexist culture and promote awareness and break taboos regarding female valorization.
