© 2022 The Author(s).This article aims to analyze the cognitive bases of Brazilian Economic Law. In this purpose, it seeks to evaluate Economic Law from its functional perspective, which seeks to explain the complex and gradual process in which the bases that cognitively nourish the tradition of Brazilian economic law were born, based on a finalistic-instrumental conception supported by social reality; the theory of underdevelopment, that introduces a political economy approach where the cognitive basis of Brazilian economic law is extracted; the logics of the Economic and Directive Constitution that outline the link between the developmentalist State's actions to certain rules, principles and goals; and, finally, its epistemological approach in Brazil based on the articulated analysis of Alberto Venâncio Filho, Washington Peluso Albino de Souza, Geraldo Vidigal, Fábio Konder Comparato, Eros Roberto Grau and Gilberto Bercovici. The objective is to provide subsidies for understanding the panorama of Economic Law in the country, within the scope of the cognitive bases outlined. It concludes that Brazilian Economic Law, in view of the established cognitive bases, can function as a legal path to development, which allows us to visualize an alternative model to the established economic system: neoliberalism.
