Força vinculante das sentenças da corte interamericana de direitos humanos: um estudo de caso sobre seu sistema de reparação

This research explores how and why the structure of judgments ruled by the Inter-American Court of Human Rights influences the binding force of these decisions. This research uses the case study methodology that allowed a careful systematization of the information obtained in the analysis of the sentences issued between 1987 and October 2017. The relevance of this study is mainly due to the fact that many of the remedies implemented in the Court's decisions influence (directly or indirectly) the public policies and agenda of the member states. In addition, this research allowed to identify and understand the alteration of the decisionmaking pattern of the inter-American judges by means of a proper methodology for collecting and analyzing the information obtained. The aim is to identify and explain the elements that have the greatest impact on the binding force of the Court's decisions, as well as to provide new hints for reflection on the rationality of inter-American judges and a proposal to adjust one of the stages of the process before this court.
