All rights reserved.The aim of this article is to examine how the legal regime for the detention of irregular migrants in the European Union Return Directive relates to the trend to criminalize irregular migration. Initially, we review the scholarship on the intersections of criminal law with migration law, in particular the concept of crimmigration, on which we base the analysis of primary sources (European Union Directives) and secondary sources (case law of the Court of Justice of the European Union). It is concluded that the regime for the detention of irregular immigrants in the EU, in the light of other international human rights instruments, is excessive and contributes to the criminalization of migration within the Union, ie the incorporation of criminal measures into migration legislation and administrative migration measures with a punitive character. The value and originality of the work lies in the analysis of the decisions of the CJEU on the scope, objectives and limitations of the Directive, which shows, from the emblematic Celaj case, an important rupture in the Court's understanding of crimmigration, by deciding, for the first time, the compatibility of the Return Directive with the criminalization of irregular migration, which opens the door to a new moment in the management of irregular migration in the European Union.
