All rights reserved.Background: Unilateral decisions of competition authorities on business operations may generate conflicting understandings. Therefore, it is necessary to study ways to settle conflicting understandings in the context of Competition Law. Objective: To verify the possibility of incorporating the concepts of convergence, criteria and international practices on merger notifications into the Brazilian context. Method: Hypothetical-deductive supported by bibliographic and documentary revisional research. Results: The analysis showed that in Brazil, as of Law No. 12,529/2011, inspired by the American and European experiences, addressed points of the merger control regime to align it with the OECD and ICN recommendations-such as the improvement of the substantial test adopted, the adoption of objective notification criteria, and the modification of the timing for submission and analysis by CADE. Conclusions: The Brazilian merger control policy is modern, developed and aligned with current international practices.
