All Rights Reserved.The criminal investigation has been treated apart from the criminal procedure, hinder-ing a better understanding about it’s conformation according the Federal Constitution. Though the distinction made by de doctrine between information elements and judge-ment elements, the proof is usually discovered in the police inquiry, serving as support to the judicial decision after the criminal procedure contradictory between the parties. Thereby, through the bibliographical review of international and national works and the comparative analyses between the civil law and common law systems, this paper tries to understand how the proof provided by the criminal investigation can be considered in the court, recognizing the police inquiry cannot be the mere informative piece to the opinio delicti formation anymore, but instead a precautionary step procedural subject to jurisdictional control and typical criminal procedure principles and rules oriented to the proof formation, as the contradictory, the equality of armas end the procedural reason-able duration.
