dc.description.abstract© The Author(s) 2019.The topic of this article is fundamental and human rights from the perspective of the Social Systems Theory, a theory developed by the sociologist Niklas Luhmann at the end of the Twentieth century. Starting from this author and other scholars, the potential of this theory will be highlighted, and consequently will be proposed future research perspectives. The hypothesis is that this theory – that conceives society as made by communication (and not by human beings) – can open up new spaces for reflection, highlighting the latent function of fundamental and human rights: as well as values of humanistic inspiration, they could represent an instrument through which society itself “builds” human beings as individuals, subjects, people.
