dc.description.abstract© 2022, Centro Universitario Curitiba - UNICURITIBA. All rights reserved.Objective: it is startded from the problem of the Brazilian public pension financial crisis. The present study aims to demonstrate the need for regulatory adjustments, as a means of providing the sustainability of social security rights, both for current beneficiaries and for current contributors (future beneficiaries), but belonging to the current generation), and also for future generations. Methodology: it is used as research techniques the bibliographic review, the consultation of official data, as well as the analysis of legal norms and, using the hypothetical-deductive method, the need to guarantee the sustainability of social security will be demonstrated. Results: it is demonstrated that intra and intergenerational responsibility in relation to social protection is a fundamental duty related to the right to legal certainty, in its collective bias. Contributions: from the diagnosis, this work intends to subsidize and encourage the debate on the existence of a fundamental duty of sustainability of social security rights, with a view to guaranteeing protection, not only for current ones, but also for future generations.
