All Rights Reserved.The paper deals with two controversial and interconnected points in Kant's theory of right of nations: the nature of states personality; and the sovereign arrangement of the World Republic. In the first point we tried to show that the difficulties of kantian interpreters in determining the type and the foundation of states personality arise from the differences in the way Kant implicitly considers the function of the moral law, which allows us to show that war rights are not a kind of natural right of states, but are based on the dignity of individuals. The elucidation of this first point also contributes to the understanding, in the second point, of the reasons for Kant's difficulties in finding a consistent arrangement for the sovereignty of states in the constitution of a World Republic. These difficulties force Kant to expose the characteristics of the World Republic not directely, but indirectly through criticism of the models of the World State and League of States. | |
