All rights reserved.The paper analyzes, from a regulatory perspective, the impacts of the normative act conveyed by Federal Council of Medicine Resolution 2.333/2023, which prohibits the prescription of steroids and anabolic steroids for aesthetic purposes, to gain muscle mass and to improve sport performance. The main objective is to problematize the reasonableness of the withdrawal form of monitoring professionals and its effects on the bodybuilding and fitness market. It uses the hypothetical-deductive method in order to stablish the limits of the professional police power. It is expected that the research will contribute to the revision of the prohibition, with the aim of replacing it with the ideia of conditional freedom, capable of avoiding unwanted self-medication, as this practice can be much less effective in guaranteeing the right to health comparing to medical follow-up.
