Abstract
The Constitution of 1988 gave a new coverage to the right to health, since it was previously a right guaranteed only to workers and dependents of the social security system, in the new Constitution became the right of everyone and the duty of the State, effected through social and economic policies. In this perspective, the demands related to the realization of social rights, especially the right to health, have been accentuated, which has been taken to the analysis of the Judiciary by many times, transforming it into a great agent of public policies. This practice passed to the members of the Judiciary, when the judicialization of social rights, the duty to analyze certain constraints of public policies that, until then, were restricted to public administrators. In this sense, the present dissertation will address the issue of excessive judicialization regarding the right to health and its economic impact on the cost of rights, analyzing its details and proposing solutions based on expert opinion.
