Resumo
Este trabalho possui a finalidade de analisar a eficácia das medidas socioeducativas previstas no Estatuto da Criança e do Adolescente aplicadas ao adolescente que comete um ato infracional. Para isso, foi realizado um estudo cronológico a respeito das legislações que já regularam a situação da criança e do adolescente no Brasil até a vigência do Estatuto da Criança e do Adolescente. Além disso, foram analisados os deveres e garantias dos menores, bem como o que se entende por ato infracional e os procedimentos para sua apuração até a aplicação das medidas socioeducativas. Por fim, as medidas socioeducativas foram analisadas e estudadas, demonstrando-se as suas características e efetividade na ressocialização e reinserção do jovem infrator.
This work aims to analyze the effectiveness of the socio-educational measures provided for in the Child and Adolescent Statute and applied to the adolescent who commits an infraction. For this, a chronological study was carried out on the legislation that have already regulated the situation of children and adolescents in Brazil until the Child and Adolescent Statute was enacted. In addition, the duties and guarantees of minors were analyzed, as well as the definitions of an infraction act and the procedures for its determination until the application of the socio-educational measures. Finally, the socio-educational measures were analyzed and studied, in a way to demonstrate its particularities and effectiveness in the ressocialization and reintegration of the young offender.
