O presente artigo tem como objetivo a discussão a respeito do atual cenário brasileiro
envolvendo a responsabilidade civil de aplicações de internet, tendo enfoque ao comércio
eletrônico. Decerto, as lides jurídicas que decorrem do comércio online de bens e serviços são
alvos de preocupação, e, mesmo com toda a discussão sobre sua natureza e a definição dos
contratos celebrados por meio eletrônico, iniciada quando do início da utilização da internet
pela população, restam diversas lacunas quanto as responsabilidades inerentes as empresas
atuantes no comércio eletrônico, as quais trazem novas modalidades de contratos atípicos quase
que diariamente. Ao longo do presente trabalho, será buscado delimitar as características do e commerce , bem como um histórico do desenvolvimento do comércio eletrônico ao longo da
última década. Será esmiuçada a responsabilidade civil de empresas atuantes no ramo
eletrônico. Por fim, o que se busca entender é de como a legislação brasileira, assim como os
operadores do direito, observam os princípios já consolidados perante as inovações e novos
contratos apresentados pela tecnologia, bem como se existe a necessidade de uma atualização
da legis para comportar as novas realidades de comércio que a sociedade brasileira experimenta.
This article aims to discuss the current Brazilian scenario involving civil liability for internet applications, focusing on electronic commerce. Certainly, the legal disputes arising from online trade in goods and services are a matter of concern, and, even with all the discussion about their nature and the definition of contracts concluded by electronic means, started when the population started using the internet, several gaps remain regarding the responsibilities inherent to companies operating in electronic commerce, which bring new types of atypical contracts almost daily. Throughout this work, it will be sought to delimit the characteristics of e commerce, as well as a history of the development of electronic commerce over the last decade. The civil liability of companies operating in the electronic business will be detailed. Finally, what we seek to understand is how Brazilian law, as well as legal operators, observe the principles already consolidated in view of the innovations and new contracts presented by technology, as well as whether there is a need for an update of the legislation to the new realities of commerce that Brazilian society is experiencing.
