Este artigo pretende perscrutar a prescrição intercorrente no processo civil, tanto na execução como no cumprimento de sentença, com enfoque no procedimento inscrito no art. 921 do CPC/15 e nas mudanças tecidas pela Lei n. 14.195/2021. Tais mudanças, a despeito de terem tido a virtude de inaugurar regras específica e sistematicamente destinadas à esfera processual civil, o que não havia sob a vigência do CPC/73, incorreram em alguns defeitos de ordem prática. As repercussões negativas dizem respeito majoritariamente à lógica da atividade satisfativa na esfera privada, mormente no que se refere a conceitos basilares como a sucumbência e a causalidade, temas aos quais se reservou especial lugar para reflexão. Argumentar-se-á que foram impostos novos obstáculos ao empreendimento executivo fundado em relação jurídica particular, já deveras sinuoso e desgastante no sistema jurídico brasileiro, seja para o particular e o causídico que lhe representa, seja para as autoridades públicas envolvidas. Esses entraves poderiam ter sido evitados com redação mais acurada em alguns dispositivos. Com isso não se quer deixar entrever que só houve mudanças negativas, longe disso. Almeja-se, enfim, introduzir e aprofundar contrapontos às dinâmicas instituídas pelo legislador, bem como tentar clarificar dogmaticamente as temáticas emergentes da questão, com o suporte sempre essencial da doutrina e da jurisprudência.
This article aims to scrutinize the statute of limitations in civil procedure, both in the execution and in the enforcement of judgments, focusing on the procedure set forth in art. 921 of CPC/15 and the changes introduced by Law no. 14,195/2021. These changes, despite having had the virtue of introducing specific and systematic rules for civil procedure, which did not exist under CPC/73, have some practical flaws. The negative repercussions are mostly related to the logic of the satisfactory activity in the private sphere, especially with regard to basic concepts such as sucumbency and causality, topics that have been reserved for special reflection. It will be argued that new obstacles have been imposed on the executive undertaking based on a private legal relationship, which is already very sinuous and wearing out in the Brazilian legal system, whether for the private individual and the lawyer representing him or for the public authorities involved. These obstacles could have been avoided with a more accurate wording of some provisions. This is not to imply that there were only negative changes, far from it. The intention is to introduce and substantiate counterpoints to the dynamics instituted by the legislator, as well as to try to dogmatically clarify the themes inherent to the issue, with the always essential support of doctrine and jurisprudence.
